Solid evidences available against Musharraf in treason trial: Attorney General --- Musharraf decides to challenge formation of special court in SC

ISLAMABAD, Nov 20 (INP): Attorney General Munir A Malik on Wednesday said that there is strong evidence against former president General (Retd) Pervez Musharraf in the treason case over imposition of emergency in the country and suspending the constitution.

Talking to media persons in the Supreme Court, he said that the government has decided to initiate trial against Pervez Musharraf under article 6 of the constitution on basis of solid evidences.

Munir Malik did not rule out that Musharraf could be re-arrested in the case during the proceedings, adding that the Federal Investigation Agency (FIA) would have the authority to carry out his arrest.

He said that according to article 6 of the constitution, the retired general could face life imprisonment or death if proved guilty, while he could also be released if no evidences were found against him.

The attorney general added that in the event of Musharraf's arrest, the jurisdiction of granting him bail would lie with the special court constituted to try the former dictator and that only the president had the power to grant a pardon.

The evidence won’t take long and the decision will be made quickly by the special court, he further said, adding that as soon as the special court receives the complaint the FIA will be authorised to make the arrest.

The special court comprising of Justice Faisal Arab (Sindh High Court), Justice Tahira Safdar (Balochistan High Court) and Justice Yawar Ali (Lahore High Court) would try the former army strongman for high treason over the imposition of emergency rule in Nov 2007.

Meanwhile, Pervez Musharraf has decided to file an application in the Supreme Court to challenge the formation of the special court to conduct trial against him.
