QUETTA: The Balochistan High Court (BHC) has directed to the SSP Traffic and the CEO Cantonment Board Quetta (CBQ) to continue their efforts to ensure the smooth flow of traffic.
These directives, the Court issued during hearing of the constitutional petition filed by one petitioner Talat Waheed Khan, the other day.
The divisional bench comprising Mr. Justice Jamal Khan Mandokhail and Mr. Justice Muhammad Ejaz Swati heard the case.
Mr. Iqbal Shah, Advocate, submitted compliance report on behalf of the CBQ and stated that measures have been taken to remove encroachments and to ease the traffic.
The report contained the detail about the steps taken in compliance of directives of this Court.
The court directed that the SSP Traffic and the CEO CBQ should continue their efforts to ensure the smooth flow of traffic.
Moreover, the NESPAK submitted two additional drawings of the project of expansion of Samungli Road Quetta, which were discussed with the Station Commander/President and the CEO of the CBQ, Chief Engineer C&W Department and other stakeholders.
All of them with consensus were agreed upon the second proposal with slight amendments.
It was told that along the road, a house and a shop of one Noor-ul-Haq, a property of Sher Ali Kakar with the name and style of “Daalan Bakers and Restaurant†and a property i.e. Post Office and two or three shops in a newly constructed building would be affected.
The Station Commander/President and the Cantonment Executive Officer of CBQ agreed for demolishing of these shops and construction of new shops on the alternate land, however they requested that the CBQ be compensated for the construction cost of the building.
At this stage, the occupants of the buildings, who are likely to be affected due to the demolishing of the building, showed no objection upon demolition of their buildings, but they requested for provision of an alternate building, equivalent to the area, already in their possession.
The Station Commander/President CBQ and the CEO CBQ conceded their request and stated that they will be adjusted in the newly constructed building and would be provided an area equivalent to their
existing space, if possible.
In view of the consensus arrived at amongst the parties, the NESPAK was directed to submit a fresh design of the project upon the C-Land, belonging to the CBQ, however the A-Land be avoided.
With regard to the compensation of the structure of the buildings likely to be affected, the Project Director and the CEO CBQ should jointly inspect the building and to assess the amount of compensation for the purpose of the superstructure only, it was directed.
While assessing so, its age and cost be kept in mind. The needful must be done by or before the next date of hearing, the court ordered further.
Meanwhile, the representative of NHA briefed the Court about the progress of the Airport Road project. He stated that there are hurdles due to the installations of PTCL and to resolve the issues, the General Manager NHA and the General Manager PTCL will meet soon.
According to him, the MEO stopped the work on the plea that the expansion in the Cantt: area is over A-Land, for which permission is required from GHQ, but the same has not been obtained. The Station Commander/President CBQ stated that the
A-Land, which is likely to be included in the project belongs to the GHQ. He stated that a concerned officer is scheduled to come to Quetta probably in the first week of April 2015, who will visit the sites of both the projects so as to take appropriate decision with regard to inclusion of proposed land in both the roads.
Both the General Managers of NHA and PTCL were directed to resolve the issues and to apprise the Court about the progress on the next date of hearing personally.
We expect that the Station Commander/President CBQ will give priority to these projects and to resolve the issue with the help of concerned officer of the GHQ at the earliest.
About the clearance of the Whyte Road, the learned DAG requested for one month’s time to take measures for security of the FC Headquarter and thereafter, the road would be opened for traffic.
The request so made was allowed by the court stressing that the needful should be done within the requested time.
Later, the court ordered to send copy of the to the IG FC, Station Commander/President CBQ, CEO CBQ, NESPAK, GM PTCL and GM NHA for compliance.
The hearing was adjourned till April 4, 2015
