Benazir murder case: ATC declares petitioner's stance weak

RAWALPINDI Oct 1 (Online): The petitioner Advocate Akhtar Shah moved a petition in the Anti Terrorism Court regarding Benazir murder case with the stance that president has exemption to appear in the court in any criminal case.
ATC judge Habibur Rehman conducted hearing of petition and said that the petitioner should be clear whether he is entitled to take such legal step on the part of former military dictator Pervez Musharraf.
Learned counsel Akhtar Shah adopted the stance that Aiwan e Sadar has an exemption in accordance with the constitution; that is why former president Pervez Mushrraf can’t be directly involved in the Benazir murder case.
FIA Prosecutor Chaudhry Azhar said that Akhtar Hussain is not entitled to move such petition.
The court consulted the petitioner on which behalf he has moved the application in the court.
Upon this, the petitioner was of the view that he has nothing to do with any party; rather he has appeared in the court just in order to guide the court.
Upon this, the court said that first of it should be determined whether the petition is maintainable or not. Next hearing of the petition would be on October 8.
